We investigate how the just cause principle is applicable to contingency planning about armed interventions in civil wars that are somewhat likely to occur in the future. According to a 2005 peace agreement that formally ended a civil war between the Sudanese government in Khartoum and the Sudan People’s Liberation Army, a referendum on South Sudan independence is to be held no later than January 9, 2011. Close observers of Sudan warn that this promise of an independence (...) referendum might not be correctly fulfilled, and that a North-South civil war is somewhat likely to recur. Focusing on the case of Sudan, we discuss the following key question, from the temporal standpoint of August 2010, the month this paper was completed: How may the just cause principle be used prospectively to decide whether there would be a just cause for armed intervention in Sudan, if a renewed North-South civil war were to occur there during the years 2010–2014? To illuminate this question of application, we also discuss a question of theory. What is the just cause principle? A core thesis is that the deterrent threat of armed intervention is an essential tool for preventing such a civil war. By means of deterrent threats of limited forms of armed intervention—for instance, the deterrent threat of imposing no-fly zones—the balance of cost/benefit calculations by the Sudanese government about the prospect of civil war might be tipped in favor of acceptance of South Sudan independence. We recommend that responsible actors in the international community should plan contingently about such armed intervention in Sudan, with the goal of preventing a renewed North-South civil war there. This article featuring Sudan constitutes one of five articles in a collection of essays on local capacity-building in research ethics by graduates from the University of Toronto’s Joint Centre for Bioethics MHSc in Bioethics, International Stream programme funded by the Fogarty International Center for Advanced Study in the Health Sciences (FIC). Research ethics is a relatively new area of practice in Sudan. In 2008, the National Health Research Council (NHRC) and health research ethics were clearly stated in the (...) Public Health Act, marking the first legislation rendering research misconduct as a legal offense. It also clearly stated that the NHRC is the focal body of health research in Sudan. Despite the difficulty in following the pace of newly-formed institutions and academies in Sudan, the NHRC’s Research Directorate assisted in the establishment of eight Research Ethics Committees (RECs) in two state ministries of health, two federal hospitals, the Sudan Medical Specialization Board (SMSB), and three universities. The provision of aid in war zones can be fraught with political difficulties and may itself foster inequalities, as it is rare to be allowed access to civilians on both sides of a conflict. Over the past decade, a United Nations brokered agreement has allowed Operation Lifeline Sudan , a UN “umbrella” organisation, to provide the diplomatic cover and operational support to allow long term humanitarian and emergency food aid to both the government and the rebel sides in the (...) long-running south Sudanese civil war. Over the years, the destruction of infrastructure in the country has meant that the provision of basic health care has been seriously hampered. Operation Lifeline Sudan has coordinated the work of most of the non-governmental organisations , working in this part of Africa. Each NGO has had responsibility for a particular area of the country and has worked closely with the local Sudanese authorities on either side of the conflict, conforming to strict codes of conduct or “ground rules”, based on neutrality. Operation Lifeline Sudan has provided an air-bridge for emergency relief supplies in regions where road access is impossible, either because of landmines, or simply because the roads do not exist. The war continues, however, and the underlying causes of war—economic exploitation, marginalisation of communities, lack of political representation, and systematic violence and abuse remain unsolved. The warring factions have brought some OLS operations in south Sudan to a standstill recently, for certain political reasons that could have compromised the neutrality of the OLS-coordinated humanitarian aid schemes. It would appear that the only resolution to the country's problems are external political pressure to get the respective combatants to negotiate and, less probably, an undertaking by countries of the developed world not to continue to supply arms. Nevertheless, OLS may serve as a model for how medical aid can be delivered in an even-handed way to the populations of countries where there is civil war, irrespective of where they may live. Peace through Commerce literature has discussed how business can engage in more responsible behavior in order to mitigate conflict risk and promote conflict resolution. However, in many conflict situations, the question arises at what point does it become impossible for a firm to remain engaged on the ground and still function as an ethical business? This article discusses the role of divestment activist groups in changing institutional norms among MNCs operating in conflict situations. Institutional norms shift from firms conducting "business (...) as usual" without heed to conflict impact, to engagement policies promoting more responsible business practices, to divestment from conflict zones when circumstances are seen to preclude ethical business conduct. Engagement and divestment are explored as tools for discouraging unethical and promoting ethical business activity, considering conflict situations in South Africa and Sudan as case examples. A stock divestment campaign is a common strategy used by social activists to pressure corporations to abandon undesirable practices. However, evidence on the effectiveness of the strategy remains mixed. In this paper, we examine the effectiveness of an international stock boycott by studying a large sample of institutional investor transactions in four emerging market stocks targeted by the Sudan divestment campaign from 2001 to 2012. We find evidence of a negative relationship between the intensity of the campaign and the (...) ownership breadth of the stocks, suggesting the effectiveness of the campaign in encouraging investors to divest from targeted companies. Additional analysis indicates that investors in countries that are sympathetic towards CSR activities are more responsive to the divestment campaign. Further, we find evidence consistent with higher campaign intensity being associated with more depressed stock prices. Finally, when performing qualitative content analyses of the annual reports and CSR reports, we find evidence about the effects of the campaign on the targeted companies’ corporate policies and activities in Sudan. In sum, our results support the effectiveness of the stock boycott. (shrink)

This article explores local, national and global aspects of the new national curriculum in South Sudan as reflected in the lived experiences of secondary school teachers. We draw on analyses of the curriculum, semi-structured interviews with 21 secondary school teachers, and classroom observations. We emphasize the need for critical global citizenship education addressing inequity and oppression at national and global levels. We argue that the curriculum rhetoric fostering global citizens is strongly disconnected from the lived experiences of the teachers, (...) where ethnicity is at the centre of their identity and a main obstacle to a unifying national identity and citizenship. Background:Promoting patients’ rights is essential for defining the standards of clinical services within a country. Given their responsibilities, nurses can be the primary target for research to investigate the issue of patients’ rights within a healthcare system. As such, assessing the knowledge of nurses about patients’ rights is an essential step toward improving the quality of healthcare in limited resource settings like Sudan.Objectives:We aimed to assess the level of knowledge about patients’ rights among the nursing staff at Friendship Teaching (...) Hospital in Sudan.Methods:This hospital-based cross-sectional study was carried out at the Friendship Teaching Hospital in Sudan. We surveyed the totality of nurses (95) at the hospital using an amended survey. The data were analyzed in SPSS software using descriptive and inferential statistics.Ethical consideration:The study was approved by the Research Unit of Khartoum Ministry of Health and the Hospital administration. All respondents gave verbal consent prior to participating in the study.Results:Only 48.4% of the participants knew about the existence of the Sudanese Charter of patients’ rights. Nonetheless, our analysis found that 65.8% of nurses had acceptable level of knowledge (scored more than 75% of the total knowledge score) of patients’ rights, and none of the participant scored less than 50% of the total knowledge score. Finally, we found no statistical association between the knowledge score and demographic data, educational level, whether the participant knows about the existence of the Charter or not and a number of other factors.Conclusion:Nurses’ lack of knowledge about the existence of the Sudanese Charter of patients’ rights adopted in 2009 rights confirms the need for further efforts by Ministry of Health to promote the document. Furthermore, further research is needed to investigate the disconnect between nurses’ lack of knowledge about the existence of the charter and their awareness of the rights within the charter as well as the actual implementation of rights. This chapter presents a synopsis of the historical evidence concerning the expansion of slavery and the trade in ivory during the Turco-Egyptian era in the Sudan between 1820 and 1881, and a description of the results of recent and very preliminary archaeological investigations at three sites associated with this trade around the town of Rumbek in Lakes State, South Sudan. The chapter begins with a brief review of the establishment of Ottoman rule in Egypt, before moving on to (...) consider the broader geopolitical forces that gave rise to the decision by the Egyptian Khedive, Mehmed Ali, to invade Sinnar, Kordofan and adjacent areas of northern Sudan. It then discusses the economic consequences and legal changes following the establishment of Turco-Egyptian rule that helped create the conditions for the expansion of slaving expeditions into southern Sudan and the establishment of a series of fortified camps or zaribas in these areas. The authors argue that, while all historical situations are in some sense unique, Sudan is not so idiosyncratic that the lessons and the precedents cannot be replicated elsewhere to protect civilians caught between warring sides in civil wars.

The ADHD Rating Scale—5 for Children and Adolescents, School Version, has been adopted and validated to be used in assessing ADHD among school children within Western contexts. However, there are few assessment tools in use for identifying ADHD characteristics in children in Sudan. Therefore, this study aimed to investigate the psychometric properties of this rating scale in the context of Sudan. To accomplish this, data were collected on a sample of 3,742 school-aged children and adolescents as reported by (...) their teachers. Psychometric properties can be classified as very good, with very high reliability, and high construct validity tested by exploratory and confirmatory factor analysis. Thus, the ADHD Rating Scale—5 for Children and Adolescents, School Version, is valid, reliable, and suitable to use for assessing ADHD symptoms among children and adolescents in the Sudanese context. There are barriers of perception between Sudanese Muslims for whom the sharia is a source of authority and identity and others who see it as an oppressive means of dominating Sudan's minority populations. I make a distinction between process and substance in law, and show that a flawed process has contributed to a perception of international law as an instrument of powerful states, which has obscured its legislative and procedural usefulness to the Sudan as a member of the (...) United Nations. Similarly a distortion of due process in Sudan's sharia has created a substance derived from the legacy of medieval Arabia rather than applied legal methodology. One consequence of this is that Sudan's Civil Wars have been given the attributes of offensive jihad against its diverse non-Muslim populations. I argue that offensive jihad was a legal construction designed to meet the challenges of medieval Arab society, with little basis in the fundamental sources of Islamic law or in contemporary legal methodology. I advocate a return to due process as a partial solution to the impasse between Muslim and non-Muslim identities in the Sudan, and show how international law can be improved by accommodating other legal traditions. COVID-19 has caused far-reaching humanitarian challenges. Amongst the emerging impacts of the pandemic is on the dynamics of human trafficking. This paper presents findings from a multi-methods study interrogating the impacts of COVID-19 on human trafficking in Sudan—a critical source, destination, and transit country. The analysis combines a systematic evidence review, semi-structured interviews, and a focus group with survivors, conducted between January and May of 2021. We find key risks have been exacerbated, and simultaneously, critical infrastructure for identifying victims, (...) providing support, and ensuring accountability of perpetrators has been impeded. Centrally, the co-occurrence of the pandemic and the democratic transition undercut the institutional and governance capacity, limiting the anti-trafficking response and exposing already vulnerable groups to increased risks of human trafficking. Findings point to increased vulnerabilities for individuals with one or more of the following identities: migrants, refugees, females, and informal labourers. (shrink)

Civil disobedience is a form of protest consisting in an act contrary to law, whose aim is to bring about a change in laws or policies deemed unjust. In the traditional Western philosophical debate, civil disobedience was mainly discussed and justified within the boundaries of a democratic regime. John Rawls’ theory of civil disobedience is explicitly based on this liberal assumption. He conceptualises civil disobedience as a public, nonviolent, conscientious and political breach of the law, only appropriate to nearly just (...) societies, hence to democratic regimes. This article intends to question Rawls’ premise by considering civil disobedience from a different perspective: when it is undertaken outside of a nearly just framework, precisely in not fully democratic contexts, such as the so-called “anocracies”, regimes that mix democratic and autocratic traits. The emblematic case of Sudan’s most recent actions of civil disobedience is examined to argue that, contrary to the liberal conceptualisation, civil disobedience does have a role and appropriateness in frameworks of this kind, where the aim is not only to oppose unjust laws or policies, but also to achieve a broader structural change through rigorously nonviolent forms of political action. Presently, there is armed conflict in Darfur, Sudan. Armed conflict has adversely affected the social, economic and educational development of Darfur, Sudan. Purpose of this study is to know the impact of armed conflict on managerial behavior of the principals of secondary schools in Darfur, Sudan. In this study, the impact of armed conflict on performance of the secondary school principals was analyzed in perspective of their managerial behavior. Based on the findings of the study significant impact (...) of armed conflict was found on the managerial behavior of the principals. It was found that principals coordinated with the staff in activities of the school but were frightened and unable to perform their administrative and managerial duties freely and independently. There was communication gap between the principals, teachers and parents. The principals did not possess the skills to maintain school budget & finance properly. It was concluded that the principals need administrative and managerial training. Government of Sudan may establish academies of Educational Administration & Management to impart training to the principals of secondary schools and to take steps to control the existing armed conflict. The purpose of this article was to analyse gender biases from the wider range of gender discussion written in Arabic textbooks Al-Asas volumes 1, 2 and 3, published by Sinan Al-Alamiyyah in Sudan. This research employed a qualitative approach with the implementation of critical discourse analysis (CDA). The results showed that unjust descriptions of female characters usually appear in textbooks: pictures of women as second-class and illustrations of gender bias. The pictures were always dominant among members of the community. (...) Furthermore, there were also positive images showing the position of women among men and women having the same rights. The findings theoretically highlighted the implementation of CDA to analyse the content of Arabic textbooks for non-Arabic speakers. As a practical implication, both readers and the users, either native or non-native Arabic speakers, could avoid the nurturance of gender biases in their social lives. The main conclusion would be that the users of the textbooks can consequently identify gender bias in the textbooks. Contribution: Through the findings of positive images on the position of women within society and women’s equality rights, it is hoped that this research would become a medium of increasing social awareness about the importance of achieving gender equality. The application of the study should include the improvement of the textbooks specifically referring to gender biases that would influence users of the textbooks in different countries. (shrink)

This paper rejects most aspects of John W. Lango and Eric Patterson’s proposal that the United States should plan for a possible intervention in Sudan on secessionist and humanitarian grounds and announce this planning as a deterrent to the central government of Sudan attacking the people of South Sudan if they would opt in a January 2011 referendum for independence. I argue that secession is not a just cause for armed intervention and that, rightfully, neither the American (...) people nor many of its men and women in uniform would be prepared to engage in an intervention that might easily escalate. I also caution that American intervention against an Islamic regime might have high global security costs. For the sake of avoiding these negative consequences and harm to the people of Sudan, available nonviolent policy alternatives should be pursued. Still, I grant that the global community should intervene in Sudan if mass slaughter of civilians were to occur as a result of renewed hostilities between North and South Sudan. My objections to Lango and Patterson’s intervention proposal appeal to jus ad bellum principles as well as just military preparedness (jus ante bellum) principles. (shrink)

Ethical reviews are carried out primarily for studies seeking international funding and are almost always governed by the funding agencies’ requirements. Nearly half of respondents (46.3%) knew about the existence of research ethics committees in Sudan. ABSTRACT At the beginning of the twentieth century, health research in the Sudan developed primarily as a function of the colonial British administration. Ethical issues in the medical profession in the Sudan are governed by the Sudan Medical Council. To address these issues, the Sudan Medical Council issued Medico‐legal and Ethical Guidelines in 1967. This important document has focused principally on ethical issues arising in clinical medicine. Throughout the history of health research in Sudan it (...) is very difficult to find any reference to research ethics. Nevertheless, there have been a few attempts to articulate ethics in health research. In 1979, Sudan witnessed the establishment of the first ethical review committee, which was established by the initiative of a group of doctors and scientists from the national health research laboratory. This committee got neither political nor institutional recognition. Therefore, it was not developed and came to an end shortly after its inception. Yet, in 2000 the FMOH established an ethical review committee (ERC). The functions of this committee were to review proposals of health research to be carried out in the country for ethical issues irrespective to the funding agents. Unfortunately, the committee devoted all the jobs in reviewing only externally‐sponsored health research and research carried out by expatriate researchers or international organisations. (shrink)
